General terms and conditions of sale

Please read these booking conditions carefully as they apply to all bookings made at the Villa Atlas Issen, managed by Morocco Haven Stay LLC.

By contracting online, the customer declares to accept the following general conditions.

The validation by the customer of his order, is worth acceptance of these general and particular conditions fully and without reserve.

The data recorded by Villa Atlas Issen on the its website constitute proof of all transactions between it and its customers. The data recorded by the payment system constitutes proof of the financial transactions. Acceptance of cookies may be necessary for any reservation on the our website.

Bookings :

 Reservation requests can be made by our website https://www.villaissen.com , by e-mail [email protected] or by WhatsApp (check the number on the website) .

 Descriptions, datasheets, rates and photos of the rooms offered and the house are visible from the website.

To make a reservation, check the availability by filling in the online booking form and specifying the number of people in your family and the dates you wish to travel.

Reservations are possible from at least two nights.

Price  Guarantee :

The prices shown on our website change from time to time. Prices may increase or decrease and you will be able to determine the current price for the rooms you have chosen before confirming your reservation. Please note that after you have agreed on a price and made your reservation, this price is the one you will pay. If the price decreases, you will not be entitled to the new rate.

Payment :

 A deposit of minium 50% of the total price of the stay, including taxes, must be paid at the time of booking. The tourist tax is charged extra.

The balance must be paid within your check in. It will be carried out in this case on the spot with the manager of the Villa Atlas Issen .

The client who has not paid the balance on the agreed date is considered to have cancelled his stay and incurs cancellation fees (cf. paragraphs cancellation fees).

Confirmed Reservations :

Once the contract is concluded, Villa Atlas Issen has the responsibility to provide you with what you have booked and you have the responsibility to pay for the accommodation. If you do not comply with this obligation, your reservation may be cancelled and you will have to pay a cancellation fee.

The relevant documentation will be sent to you by e-mail. You should definitely check all the details of your reservation carefully when you receive it, and contact us immediately if you have any questions. Villa Atlas Issen is not responsible for the non-receipt of information when you have not provided a valid email address.

If you wish to cancel or change your reservation at a later date, you may be required to pay a cancellation or modification fee which may be equal to the total price of the accommodation.

Rental fees

The rental fees covers :

• Cleaning before renting, and If you stay more than a week, it’s once a week.
• Sheets and towels changed every week
• Cleaning and maintenance of the pool
• Water / hot water

The rental fees does not cover additional services/fees:

• Additional persons : 50 $ / person / night. You are only allowed to add up to 2 persons.
• Additional cleaning : 15$ / hour. If the client leaves the property in poor condition, additional cleaning fees will be charged.
• Additional change of sheets and towels: 10$ / person

Check-in & Check-out

Check-in & Check-out time : You can arrive from 3:00 pm and you must leave the property no later than 12:00.

Number of nights: The number of nights indicated in the booking confirmation refers to the number of nights for which the accommodation was booked for you.

 Some flights may be night flights. When you arrive in Agadir the villa will be available only if you have booked it for the night of your arrival.

Cancellation & change of booking policy

Cancellation  booking :

The cancellation of the reservation by the customer must be made in writing, signed and addressed by mail or email to Villa Atlas Issen . In case of cancellation either due to the customer, or automatically due to non-payment, variable compensation is due according to the date of reception of your notification to Villa Atlas Issen, according to the following scale :

You can cancel your reservation up to 30 days before check-in at no charge (less a processing fee of 35$ from our payment provider that must always be paid when cancelling a reservation). The 35$ fee also applies if you want to cancel only some of the nights booked.

In case of cancellation from 29 to 15 days in advance, we charge a non-refundable fee of 25% of the total price of the reservation.

 In case of cancellation 15 to 10 days in advance, we charge a non-refundable fee of 50% of the total price of the reservation.

FOR CANCELLATIONS LESS THAN 10 DAYS BEFORE CHECK-IN, THE TOTAL COST OF THE RESERVATION OF 100% IS NOT REFUNDABLE.

No refunds for no shows – this counts for flight schedule issues, car breakdowns, illness, closed roads or weather problems, accidents, conflicts of schedules or any other reason for which you cannot go to our Lodges on the day of your check-in. No refund is made for early departure for the same reasons as above.

Non-refundable fees cannot be used as credit for a future booking.

Any cancellation or modification made by Villa Atlas Issen of a confirmed and paid reservation, will be notified to the client and will entitle him to full refund of the amounts already paid without further compensation. However, as far as possible, Villa Atlas Issen will offer the customer an alternative solution of the same or higher category without any price change.

The refund will always be made exactly as you paid it. No other transfers to other accounts or credit cards are permitted for security reasons. When you receive a refund from us, it will take 7-14 business days to process the transaction.

Please note that there may be exchange differences when you receive your refund and have a card that does not charge in your currency. It depends on your card/bank provider.

Villa Atlas Issen reserves the right to cancel reservations and bookings, when it is unable to provide the company’s services due to a case of force majeure such as, but not limited to, weather conditions, strikes, natural disasters, or any other irregularity beyond the control of the company. In the event that Villa Atlas Issen cancel a reservation on their behalf, they will refund the customer.

If Villa Atlas Issen must limit a reservation or service due to technical problems or limited services in the Villa, a partial refund will be made according to the severity of the problem.

Villa Atlas Issen reserves the right to update/change these booking and cancellation policies without notice and without affecting contracts already signed.

The contract is subject to these general booking conditions and Moroccan law.

change of booking :

Changing your reservation to other dates less than 30 days before check-in is not possible without a fee. The same rules as for cancellation apply in this case (25 to 100% fee). Non-refundable fees cannot be used as credit for a future booking.

 We only change booking dates up to 3 Months in advance from the original booking date. Prices vary according to the season, we cannot guarantee the same price as your original booking.

INSURANCE

It is strongly recommended that you and all members of your group take out adequate travel insurance which will cover the cost of cancellation, interruption, medical and repatriation expenses, loss of luggage, personal effects, damage, personal injury and cash/valuables. Villa Atlas Isse, is not responsible for any loss or damage to property of guests left in the villa and/or in the all of the farmstay at any time.

Expulsion due to bad behavior

When you book accommodation, you accept responsibility for damage to property or, in the farmstay, which may be caused by you or a member of your group. Villa Atlas Issen reserves the right to terminate your stay or that of a member of your group if, in the reasonable opinion of the manager, the client’s behaviour is likely to cause damage to the property. In these circumstances, the full cancellation fee will apply and no refund will be made.

You will have to reimburse Villa Atlas Issen for the damages caused, before the end of your stay.

Furthermore, Villa Atlas Issen will not be obliged to pay any compensation or cover any expenses you may incur following an early termination of your stay.

Security deposit/guarantee

Before your arrival you will be asked for a security deposit. The security deposit is fully refundable within (14) days of departure, provided that the following provisions are met :

– No damage is done to the property or its contents, beyond normal wear and tear;

– The furnished accommodations are fully equipped with dishes, cutlery, bedding, household and bath linen, electrical appliances…All of them are not lost or damaged.

– No damage incurred due to illegal activity, because of the animals and that the paid services rendered during the stay are well paid;

– All debris, waste and discards are placed in a dumpster, and clean dishes or in the dishwasher

– All keys are left in the secure box;

– All fees accrued during the stay are paid before departure;

– No sheets or towels are lost or damaged;

– Tenant was not evicted by the landlord (or landlord’s representative) or by local law enforcement;

You are responsible for any damage caused by misuse of the villa and the payment of repairs or replacement of damaged items will be at your expense and will be deducted from the security deposit in the first instance or charged in full if the deposit is insufficient or if the deposit was not requested at the beginning of the stay.

Atlas Villa Issen reserves the right to collect 100% of the security deposit in case of breach of the general conditions of sale.

RESPONSIBILITIES

Villa Atlas Issen decline any responsibility for incidents/ accidents and their direct or indirect consequences, which may occur to goods and/ or people (clients/ occupants/ guests), in our property.

Children present in the Villa Atlas Issen are placed under the sole responsibility of their parents/ legal representative, and should not be left alone in the house unattended.Similarly, Villa Atlas Issen shall not be held responsible in the event of interruption or failure of public services such as: We expressly point out that you are personally responsible for keeping valuables in safe places: jewellery, money, credit cards, photo or video equipment, etc… Villa Atlas Issen is not liable for loss, theft, damage, etc…

POLICE FORMALITIES

Villa Atlas Issen is required to complete the usual police formalities in order to satisfy the local authorities. The police form must be completed upon arrival.

ADMISSION TO THE VILLA ATLAS ISSEN

We reserve the right to enter at any time and we reserve the right to refuse to rent the property or to give access to its other areas. The protection of the clients and visitors, and the reputation of the property are of paramount importance. If, in our reasonable opinion, there is any doubt about a potential client/visitor, access to the property may be refused.

Only the owners and customers have permanent access. No person, in addition to the number of occupants provided for in the initial booking, is allowed to stay even occasionally in the property. Accordingly, customers are obliged to report to the manager, all persons they would like to invite, at the latest on the day before their arrival.The Manager is entitled to refuse entry to any guest, without having to justify, even if the acceptance had been obtained beforehand.

In case of acceptance, the manager of Villa Atlas Issen will count this additional occupant and ask them to complete a police card.

You are responsible for you and your visitors conduct while you are on the premises at all times, including without limitation orderly conduct in the facilities and amenities of the property. Failure to comply with this clause will result in immediate cancellation of the reservation without compensation.

These general conditions as well as the internal rules of the Residence are applicable to the guests/visitors.

PROHIBITED USES OF OUR SERVICES

You agree, for yourself and your guests or visitors, not to use the Villa Atlas Issen or its services for illegal purposes or in violation of Moroccan law or any other law applicable to the use of the guest house’s services. Examples of prohibited uses include, but are not limited to:

The commission of any criminal offence, including possession and use of controlled drugs and possession and storage of firearms and shotguns.

Discriminatory behaviour or other behaviour that violates the dignity of a person directed by you or your guests/visitors to another person or persons inside the guest house, including other guests/visitors or staff of the guest house, whether verbal or not, which is sexual or racial in nature or based on disability, age or sexual orientation.

Any form of verbal or non-verbal conduct that could be considered violent, intimidating or intimidating, such as unsolicited touching of guests/visitors or staff at the guesthouse.

Conduct of guests/visitors that impairs the privacy of another person or persons, including staff of the guest house.

Entertainment of courtesans or persons employed for the purpose of sexual gratification at the guesthouse.

Present yourself as an employee, agent or other representative of the guest house.

Any action or act likely to damage the morality or reputation of the guest house and/or discredit its name;

To present themselves to operate a business in the premises of the guest house without written authorization from the management of the guest house.

Soliciting goods and services from guests/visitors and staff of the guest house without their express consent, installing recording and monitoring equipment anywhere on the premises of the guest house (for the protection of the privacy of all our customers/visitors) film and/or photograph for public use in any area of the guest house without our prior written permission, commercial photography or film without our prior written consent, and use of our intellectual property, including trademarks or trade names without our prior written permission.

EVENTS BEYOND OUR CONTROL

These include, but are not limited to: war, threat of war, riot, disobedience or civil unrest, government action, terrorist activity, natural or industrial disaster, fire, adverse weather conditions, floods, airport closures.

It may also be labour disputes involving third parties, technical or maintenance issues or unforeseen operational decisions by air carriers such as schedule changes or computer infrastructure or Internet connections failures.

 Unless otherwise stated in these booking conditions, Villa Atlas Issen regrets that it cannot accept liability or pay compensation when the performance of its contractual obligations is prevented or affected due to such events beyond its control.

HEALTH, SAFETY AND SECURITY ABROAD

Morocco is a Muslim country that follows Islamic laws and customs. Be aware of what you are doing to make sure that you do not offend, especially during the holy month of Ramadan or if you intend to visit religious places. You must respect local traditions, customs, laws and religions at all times.

Unfortunately, crimes committed against people and their property are part of everyday life around the world, and during a stay it is very important to be vigilant and avoid attracting attention by wearing expensive jewelry, by carrying expensive photo equipment etc… Travelers have the same responsibility for their personal safety and the safety of their property as they do at home. We strongly advise you to take reasonable precautions to protect yourself and your family during your vacation.

The villa is in the middle of a farm, an ecosystem where can lives several insects, reptiles and small animals, some of them can be poisonous, so please take care of yourself and especially your children, guests and your pets. We decline any responsibility in case of any accident.

Customers use the pool and the area around the pool at Villa Atlas Issen at their own risk. We The pool is not supervised. We decline any responsibility in case of accident (be careful with yourself, your guests, your children and your pets).

The villa is equipped with an outdoor swimming pool, we cannot predict the practicability of the pool and the water temperature. The practicability is strongly correlated to the weather.

Safety in the farm

Villa Atlas Issen is located in a working farm. For the safety of all inside the farm, it’s very important to follow our advise:

swimming in the Irrigation Ponds is prohibited

Animals are unpredictable. Keep clear of them.

Especially supervised young children closely.

You are entering our property at your own risk and we hold no responsibility for any accident or injury incurred while staying with animals or other farm equipment.

You visit the whole farm at your own risk. This is a working farm with hazards both farm related (ie. machinery and animals) and natural (ie. Prickling foliage)

Leave gates as you find them – if closed, please ensure you double check the latch has been closed properly.

For your own safety please do not touch any farm machinery, and do not enter the farm buildings on the property unless given permission to do so.

All guests agree to the rules and guidelines as outlined in the registration form

Management reserves the right to ask any non-conforming guests to leave the property.

CUSTOMER CONTACT

When booking, you provide Villa Atlas Issen with your personal information including an email address. This information is used only for the purpose of booking.

 The email address is used to send you confirmations and the booking voucher (voucher). The customer is responsible for the validity of the email address, and the contact details provided. In case of incorrect entry, Villa Atlas Issen declines all responsibility.

Villa Atlas Issen may also use your email occasionally to send you information about the property (promotion, events,…). Villa Atlas Issen undertakes not to transmit this email to a third party (private or professional) for commercial purposes.

In accordance with the law on data processing and freedoms dated 6 January 1978, you also have the right of access, rectification, modification and deletion of your data. You can exercise this right by sending an email to [email protected]

General rules

Minors : Villa Atlas Issen does not accept bookings made by minors. You must be at least 18 years old and have legal capacity.

Special requests : If you have any special requests that are not part of the standard accommodation services described on this website (for example, late arriving to the accomodation), please let us know before making your reservation. We will try to meet these demands but unfortunately we cannot guarantee it.

Access for disabled: Unfortunately, Villa Atlas Issen does not have a lift.

Tobacco : Please note that smoking is not permitted inside of the villa. Smoking is allowed in certain areas outside.

Pets : We know how important your pet is to you. That’s why we want you to enjoy your holiday with us in his company. To make your stay pleasant and not violate the rules of stay in Villa Atlas Issen, we ask you to respect the following rules:

– As the owner of your pet, you are solely responsible for any and all actions that your pet may take. Your pets must always be supervised.

– Pets are not allowed to climb on furniture in the villa or bedroom (beds, sofas, chairs …), and in the pool, bathrooms and showers.

–  Don’t use any household linen (towels, sheets, duvets etc.) to clean your pet.

–  The owners of the property are not responsible for any illness or injury that may occur to humans or pets during the rental period.

– We do not accept dangerous breed animals.

Allocation of jurisdiction & Choice of domicile.

The property Villa Atlas Issen is managed by Morocco Haven Stay Sarl

The parties submit this contract to Moroccan law.

Any conflicts relating to the interpretation and execution of this contract will be the exclusive jurisdiction of the courts of the city of Agadir.

For the execution of this contract and its consequences, Morocco Haven Stay will be domiciled at its headquarters and the customer at his personal address or his representative in Morocco.
